{"id":226558,"date":"2025-10-09T10:53:24","date_gmt":"2025-10-09T17:53:24","guid":{"rendered":"https:\/\/www.insidephilanthropy.com\/?p=226558"},"modified":"2025-10-15T10:53:44","modified_gmt":"2025-10-15T17:53:44","slug":"how-are-funders-responding-to-the-administrations-threats-to-the-sector","status":"publish","type":"post","link":"https:\/\/www.insidephilanthropy.com\/home\/how-are-funders-responding-to-the-administrations-threats-to-the-sector","title":{"rendered":"How Are Funders Responding to the Administration\u2019s Threats to the Sector?"},"content":{"rendered":"\n<div class=\"wp-block-genesis-blocks-gb-container gb-block-container\"><div class=\"gb-container-inside\"><div class=\"gb-container-content\">\n<p>After months of threatening language from the White House and its allies, few in the philanthrosphere were surprised by reports that the Trump administration <a href=\"https:\/\/www.insidephilanthropy.com\/home\/targeting-osf-trump-aims-for-a-chilling-effect-on-liberal-funders\">plans to investigate George Soros\u2019 Open Society Foundations<\/a>. Still, the news was delivered as the first blow in a one-two punch: The president also issued a <a href=\"https:\/\/www.whitehouse.gov\/presidential-actions\/2025\/09\/countering-domestic-terrorism-and-organized-political-violence\/\" target=\"_blank\" rel=\"noreferrer noopener\">presidential memorandum<\/a> that heralded \u201ca new law enforcement strategy that investigates all participants in these criminal and terroristic conspiracies \u2014 including the organized structures, networks, entities, organizations, funding sources, and predicate actions behind them.\u201d Both moves raise very real concerns that the administration intends to aggressively go after philanthropic and nonprofit organizations with which it disagrees.\u00a0<\/p>\n\n\n\n<p>The response from funders was swift. A few excerpts from statements posted on LinkedIn:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>From John D. and Catherine T. MacArthur Foundation President <a href=\"https:\/\/www.linkedin.com\/posts\/activity-7377056363291652096-Q4_u\/?utm_source=share&amp;utm_medium=member_desktop&amp;rcm=ACoAAADTGN8Bf_YF9b2bj8uMmmXX2V0vtRRCXe4\" target=\"_blank\" rel=\"noreferrer noopener\">John Palfrey<\/a>: \u201cWhen the federal government investigates a charitable foundation simply for giving in accordance with their beliefs, it is a threat to our fundamental American freedoms\u2026 The Open Society Foundation has the right to fund in accordance with its values, to work to strengthen democracy and uphold our constitutional freedoms.\u201d<\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li>From the <a href=\"https:\/\/www.linkedin.com\/posts\/democracy-fund_the-reported-efforts-by-the-federal-government-activity-7377032765994819584-fimv\/?utm_source=share&amp;utm_medium=member_desktop&amp;rcm=ACoAAADTGN8Bf_YF9b2bj8uMmmXX2V0vtRRCXe4\" target=\"_blank\" rel=\"noreferrer noopener\">Democracy Fund<\/a>: \u201cThe reported efforts by the federal government to manufacture criminal charges against the Open Society Foundations is yet another deliberate attempt to instill fear, punish dissent, and fracture civil society. It is an affront to the First Amendment and the Constitution\u2019s core commitment to free expression.\u201d&nbsp;<\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li>From Freedom Together Foundation President <a href=\"https:\/\/www.linkedin.com\/posts\/deepak-bhargava-a5a6a3155_first-law-firms-then-universities-then-activity-7377020781576482816-IBPu\/?utm_source=share&amp;utm_medium=member_desktop&amp;rcm=ACoAAADTGN8Bf_YF9b2bj8uMmmXX2V0vtRRCXe4\" target=\"_blank\" rel=\"noreferrer noopener\">Deepak Bhargava<\/a>: \u201cThe Department of Justice\u2019s politically motivated efforts to manufacture baseless criminal charges against the Open Society Foundations are an affront on our Constitutional right to free speech and every American&#8217;s right to give and invest. It is the administration\u2019s latest step to politicize and weaponize the federal government against groups that disagree with its policies.\u201d&nbsp;&nbsp;<\/li>\n<\/ul>\n\n\n\n<p>For Carmen Rojas, the president and CEO of the Marguerite Casey Foundation, which also posted a <a href=\"https:\/\/www.linkedin.com\/posts\/marguerite-casey-foundation_reporting-from-the-new-york-times-that-the-activity-7377332632419766272-BxfT\/?utm_source=share&amp;utm_medium=member_desktop&amp;rcm=ACoAAAR-AxcBuhtkaoJIORgOIFrT1__WRuDSSFA\" target=\"_blank\" rel=\"noreferrer noopener\">statement<\/a>, the administration\u2019s recent actions are another example of its \u201cflood the zone\u201d approach, which serves to overwhelm and distract.&nbsp;<\/p>\n\n\n\n<p>\u201c[Their strategy] is to shine a light away from what is actually happening in our country,\u201d she said in a recent interview. \u201cWe&#8217;re about to experience the largest transfer of wealth from poor and working people to rich people in this country, so this administration keeps trying to shine a light somewhere else. Look over there. Look at the universities, look at the law firms. Look at OSF. This administration is creating a permission structure to steal the people&#8217;s resources and line their pockets, and they&#8217;re using any possible distraction to make that happen.\u201d<\/p>\n\n\n\n<p>Lawson Bader, the president of DonorsTrust, a conservative and libertarian-oriented DAF sponsor, also spoke out. \u201cWhen Stephen Miller starts talking about an organized strategy against left-leaning organizations, that\u2019s where the White House\u2019s rhetoric gets dangerous,\u201d Bader told <a href=\"https:\/\/www.thefp.com\/p\/conservative-philanthropy-ceo-to\" target=\"_blank\" rel=\"noreferrer noopener\"><em>The Free Press<\/em><\/a>. \u201cIf an organization feels strongly about abortion or perceived income inequality, I may disagree with their motivations, but the way we battle it out is in civil society.\u201d Bader posited a day when a different administration holds power. \u201cWe know what Trump doesn\u2019t like,\u201d he told <a href=\"https:\/\/www.philanthropy.com\/article\/trumps-order-to-investigate-liberal-groups-is-likely-to-face-legal-challenges\" target=\"_blank\" rel=\"noreferrer noopener\">the Chronicle of Philanthropy<\/a><em>.<\/em> \u201cWhat might President AOC not like?\u201d<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Philanthropy-supporting organizations speak up<\/h2>\n\n\n\n<p>Other organizations in the philanthrosphere, and their leaders, also expressed concern after the administration targeted Open Society, including <a href=\"https:\/\/www.linkedin.com\/posts\/kathleen-enright-2252407_as-a-national-membership-association-with-activity-7377047743778930689-y6BY\/?utm_source=share&amp;utm_medium=member_desktop&amp;rcm=ACoAAADTGN8Bf_YF9b2bj8uMmmXX2V0vtRRCXe4\" target=\"_blank\" rel=\"noreferrer noopener\">Kathleen Enright<\/a>, the president and CEO of the Council on Foundations, and the <a href=\"https:\/\/www.linkedin.com\/posts\/national-center-for-family-philanthropy_yesterday-the-new-york-times-reported-that-activity-7377419289114451968-pnyB?utm_source=share&amp;utm_medium=member_desktop&amp;rcm=ACoAAAR-AxcBuhtkaoJIORgOIFrT1__WRuDSSFA\" target=\"_blank\" rel=\"noreferrer noopener\">National Center for Family Philanthropy<\/a><em>.&nbsp;<\/em><\/p>\n\n\n\n<p>Independent Sector, another key sector organization and membership group, also registered its concern. \u201cIf there is malfeasance, that can be looked at and investigated; there is an established IRS process for that,\u201d said Jeffrey Moore, chief strategy officer at Independent Sector, in a recent interview. \u201cWhether it&#8217;s this president or a future president, for any executive to be able to reach over that process and summarily strip away nonprofit status based on some sort of political grievance or retaliation \u2014 that fundamentally undercuts the premise on which a free society, and the First Amendment, is built,\u201d he said.&nbsp;<\/p>\n\n\n\n<p>Akilah Watkins, Independent Sector&#8217;s president and chief executive, drew a distinction between disagreement and wrongdoing in a <a href=\"https:\/\/www.linkedin.com\/posts\/drakilahwb_the-federal-governments-targeting-of-charitable-activity-7377118602765737984-iTDX\/?utm_medium=ios_app&amp;rcm=ACoAAACSdyYBKK7plZy919ndEB206gXY0PRuhUw&amp;utm_source=social_share_send&amp;utm_campaign=mail\" target=\"_blank\" rel=\"noreferrer noopener\">statement<\/a> on LinkedIn. \u201cWe condemn any effort to mischaracterize or intimidate lawful organizations simply because their missions challenge political preferences,\u201d she wrote. \u201cWe must not conflate disagreement with wrongdoing. The strength of the independent sector lies in its freedom: to innovate, to dissent, and to serve communities in diverse ways. That freedom is not a flaw; it\u2019s a cornerstone of what makes our society truly democratic.\u201d<\/p>\n\n\n\n<p>Disagreement around mission \u2014 versus proof of wrongdoing \u2014 is evident in the recent report on OSF <a href=\"https:\/\/www.insidephilanthropy.com\/home\/the-philanthropy-backed-think-tank-behind-trumps-soros-investigation\">published by the Capital Research Center<\/a>, which the Trump administration appears to be using as evidence in its investigation of the progressive grantmaker. Despite the overheated language and frequent use of ominous terms like \u201cterrorism\u201d, \u201csabotage\u201d and &#8220;anti-American,&#8221; CRC fails to provide evidence of actual criminal behavior on the part of the foundation or its grantees.&nbsp;<\/p>\n\n\n\n<p>The president and administration officials also appear to be conflating opposition to their agenda with wrongdoing. In recent weeks, the president has warned darkly of the \u201c<a href=\"https:\/\/www.npr.org\/2025\/10\/01\/nx-s1-5558336\/trump-says-u-s-military-should-be-used-to-fight-the-enemy-within\" target=\"_blank\" rel=\"noreferrer noopener\">enemy within,<\/a>\u201d and administration officials have invoked, without evidence, the specter of a violent, left-wing network to justify a crackdown on those with whom they disagree. In response to a recent judicial ruling he opposed, White House Deputy Chief of Staff Stephen Miller <a href=\"https:\/\/x.com\/StephenM\/status\/1974534850334933179\" target=\"_blank\" rel=\"noreferrer noopener\">posted this<\/a>: \u201cThere is a large and growing movement of leftwing terrorism in this country. It is well organized and funded. And it is shielded by far-left Democrat judges, prosecutors and attorneys general. The only remedy is to use legitimate state power to dismantle terrorism and terror networks.\u201d<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">A collective response from philanthropy to deter authoritarianism&nbsp;<\/h2>\n\n\n\n<p>The administration\u2019s efforts to single out George Soros\u2019 philanthropy don\u2019t surprise <a href=\"https:\/\/hardymerriman.com\/about-hardy-merriman\/\" target=\"_blank\" rel=\"noreferrer noopener\">Hardy Merriman<\/a>, an author and independent international democracy expert who previously led the International Center on Nonviolent Conflict and has studied pro-democracy movements and authoritarian regimes around the globe.&nbsp;<\/p>\n\n\n\n<p>\u201cAspiring autocrats are not strong enough to accomplish all of their goals at once,\u201d he said. \u201cThey are not strong enough to take on the sector as a whole, so the only way they can stop the sector quickly is by spreading fear. They single out a few examples and try to isolate them through attacks in the media or otherwise, and then hope that the sector gets scared enough to start censoring itself. This is a test, and for those who think that being quiet in moments like this is going to deter the administration, I would disagree. The administration is emboldened when it gets its way as a result of bullying and fear.\u201d&nbsp;&nbsp;<\/p>\n\n\n\n<p>That is why funders rallying to OSF\u2019s defense is so important, Merriman said. \u201cThe best way to deter future attacks is to stand strong \u2014 early and together,\u201d he said. \u201cWhen met with collective response, the administration has backed down. I haven\u2019t heard the administration talk much about Jimmy Kimmel since he got back on the air, and that\u2019s because they lost and they would like us to move on as quickly as possible. More recently, <a href=\"https:\/\/www.insidephilanthropy.com\/home\/funders-push-back-as-the-trump-administration-targets-philanthropy\">funders responded after the administration singled out<\/a> the Open Society Foundations and the Ford Foundation in the wake of Charlie Kirk\u2019s assassination.&nbsp;<\/p>\n\n\n\n<p>Merriman had suggestions for other ways funders can stand up to attacks on the sector, including increasing their spend-out rates, supporting programs that protect civil society, and stepping up efforts to work with other sectors, including civic associations, universities, unions, faith communities and other groups.&nbsp;<\/p>\n\n\n\n<p>The MacArthur Foundation and the Freedom Together Foundation both increased their payouts this year, <a href=\"https:\/\/www.insidephilanthropy.com\/home\/https-www-insidephilanthropy-com-home-as-crisis-drives-payout-bumps-a-small-chicago-funder-challenges-conventional-wisdom\">as Wolfe reported<\/a>, as did the <a href=\"https:\/\/www.insidephilanthropy.com\/home\/the-story-behind-marguerite-caseys-supercharged-trump-era-giving\">Marguerite Casey Foundation<\/a>. Ashleigh Subramanian-Montgomery, acting director of the Charity and Security Network, is urging funders to do even more to support nonprofits. \u201cWe are telling the organizations we work with to be adamant with funders, that if they don\u2019t fund us now there may not be a sector left,\u201d she told<em> <\/em><a href=\"https:\/\/www.wired.com\/story\/the-trump-administration-is-coming-for-nonprofits-theyre-getting-ready\/\" target=\"_blank\" rel=\"noreferrer noopener\"><em>Wired<\/em><\/a>.&nbsp;<\/p>\n\n\n\n<p>Independent Sector is working to help nonprofits and foundations stay informed about the latest policy changes and administrative actions through its tax and federal legislation, litigation and executive action <a href=\"https:\/\/independentsector.org\/policy\/tracking-the-policy-landscape\/\" target=\"_blank\" rel=\"noreferrer noopener\">trackers<\/a>. \u201cOne of the things that nonprofit leaders need right now is a good, reliable, steady stream of information when these things come down,\u201d Moore said. \u201cBe it an executive order or a presidential memorandum, folks really need to understand what it says and what it means.\u201d<\/p>\n\n\n\n<p>Along with providing additional financial resources, philanthropy can help nonprofits by offering assistance with research, and with legal or crisis communication services, Moore said. \u201cI think for funders, it&#8217;s super important that they&#8217;re talking to their grantees and having open communication about what the needs are,\u201d he said. \u201cAnother thing that is critically important for philanthropy to do \u2014 and we&#8217;re gratified to see more of this happening \u2014 is to remind grantees and make it possible for grantees to use their voices as advocates for their mission areas, within the rules of what is permissible, of course.\u201d (See the Independent Sector\u2019s <a href=\"https:\/\/independentsector.org\/nonprofit-advocacy-civic-engagement-research\/\" target=\"_blank\" rel=\"noreferrer noopener\">in-depth analysis <\/a>of nonprofit advocacy and civic engagement).<\/p>\n\n\n\n<p>Marguerite Casey\u2019s Rojas is also aiming to ensure that the foundation\u2019s investments align with the organization\u2019s&nbsp; values, an effort which she hopes more funders will pursue as some private sector actors enable authoritarianism. \u201cMany of our institutions normally give out 5%, and may have 95% of their resources invested at counter or cross purposes to their mission,\u201d she said. \u201cThey may be invested in companies that are advancing the autocratic slide in one way or another \u2014 companies that are benefiting from our public dollars and whose leaders have shown themselves to be deeply undemocratic in their practices. Instead, we can be resources for good, creating the wind in the sails of our grant recipients by investing in economic models that don&#8217;t require exploitation or extraction.\u201d&nbsp;<\/p>\n\n\n\n<p>Meanwhile, Rojas intends to continue speaking out, and she believes others in the sector will do the same. \u201cWhat we have seen over the last 10 months is a strategy of divide and conquer, and I&#8217;ve been really proud to see [a large] number of philanthropy CEOs, boards and nonpartisan organizations come together to defend the constitutionally protected rights that people and institutions have in this country,\u201d she said. \u201cThe thing that has made me so inspired and buoyed me with hope in this moment is that in spite of differences in boards, differences in approaches, differences in issue areas, folks have come together in a resounding stance to protect our freedom of speech and our freedom to give.\u201d<\/p>\n<\/div><\/div><\/div>\n\n\n\n<div class=\"wp-block-genesis-blocks-gb-container gb-block-container\"><div class=\"gb-container-inside\"><div class=\"gb-container-content\">\n<div
